So if Rob is gonna start making people pay for his old videos, he's probably going to try to have the site taken down right?
How in the world would he lose?
well all of his videos were availible publicly before he took them down, and many of them were posted to other platforms that might have their own conditions for that kind of thing
also he said in discord people could back them up so it's legal Kappa
I really don't think one message on discord would make it so his work can legally be uploaded anywhere, and i'm pretty sure he still has ownership of his stuff even if it was uploaded on other platforms. It may be costly, but I really doubt Rob would lose a court case

assuming rob had a 100% take-down case, he'd still have to actually have something to argue it to its full extent
has this situation had any precedent before though
I think of it like uploaded episodes of a discontinued TV show online, it was available publicly on TV at one point but the people who made it still have ownership of it

How this plays out is Rob emails Spooky a Cease and Desist, then spooky either ignores it, or tells Rob to have his lawyer contact him

This is the simple truth. Lawyers cost money. Even if Rob had a decent case, he'd need Spooky's details to sue him directly. I don't know how sending a C&D to a Peertube site would work since it's an open-source decentralized platform.
There are ways to get spooky's info, courts can demand that the company he bought the domain from disclose his info for example I think
but all of it takes lawyers
it is literally not worth doing
both time and the fact that all it will do is cause both Rob and Spooky to be left with less money
