used incorrectly is mostly down to, parents/relatives only gift some funds at birth, and then they sit there and invested automatically with a bad target year curve.
funds added in the last 5 years are also treated completely differently, to prevent parents from "gaming" the system to dodge taxes
my big issue is like a lot of financial things, it's impossible to understand wtf they are for most people, and all the nuance of how to use them right and which "hacks" to use to fully advantage using them
custodians also have too much power to easily withdraw funds from them
and my big thing is (like HSAs) you set up these good mechanisms to save people a lot of money, but then penalize them for how far off on their predictions they were, which often then leads people to overspend to not "lose" some of those advantaged funds
if the stars align and they're used perfectly, congrats, you win
but most of the time they're well-intentioned but ultimately less efficient than other ways of saving
Trump Accts, (beyond that the seed money is free) seem better and more flexible on paper, will have a MASSIVE enrollment base, and be a political football that is more broadly understood and discussed
