you know, my initial reaction was that's a stupid and petty thing that will go nowhere
but there's an interesting meta discussion on how do you authenticate any presidential action
or really, any action that is the will of an individual
I think literally any other position of power (including congress, doctors, etc.) allow a discretionary delegation of authority
the president is the only position that explicitly doesn't allow that, you must delegate to the vice president and only to him, who then himself must delegate according to the succession order
but the idea that we authenticate anything by signature is kind of a meme
things are "authentic" because they're entered into the legal record by some intern in the West Wing who uploads a .pdf copy of the order to the LoC
who himself; on occasion, will fuck up and upload the wrong file
and if he uploads the wrong file, the correction is made by another random bureaucrat, who purports to know the will of the president
if rather the authenticity is determined by the video of the signing occurring (like major bills/actions have) then minor acts are neglected
How much actually goes across the presidents' desk that needs signing, and is it an amount that actually would "need" an autopen?
we used to use it all the time
because our senator was really vain about his signature looking "perfect"
but, for them it doesn't even matter, because the only records of note are voting records that are recorded as public tallies in the congressional chamber, signing shit is not necessary
and you can delegate anyone to vote on your behalf, which is never questioned
(though, it's only because there's an assumption that others would keep you in check and would reasonably know whether you were authorized to cast that vote or not)
I think they changed some of the proxy voting rules during covid, so now you can't share proxies
but I'm not an expert on modern house/senate rules because they've gotten silly
If there was, every single president would do it to the last guy
that does not happen, ergo no, it has not happened before
If trump does this, and its allowed, all this accomplishes is removing the presidential pardon from being a thing
