I'm tired of midwits thinking case law and the supreme court are how we figure out what is/isn't legal
My understanding of the whole Internet Archive drama is also that, they are in the right, but there are two conflicting laws in whatever state they are being sued in
if they win, piracy and libraries are legal, if they lose libraries are functionally illegal
I hope they shutdown libraries over this
they won't
but it would be funny
people are anti-piracy out of necessity, despite the fact that if piracy was 100% legal with no limitations
very little would fundamentally change
book lending is the absolute best court case that could be brought
because you're literally arguing to shut down libraries, based on an outdated law in one state
but regardless, just legislate it
the people who care (young and the poor) don't vote though, and are too politically disconnected to do anything
because I actually think most politicians would vote in favor of libraries
other than the stupid conservative grifter ones
this court case can't win, because it would legalize piracy, but it's a stupid case
I really mean that first part though, if suddenly piracy was legal in America (as it is in a handful of countries already) nothing would change
the cost to host/serve media and the featuresets that can be built via a subscription fee or up-front cost are worth it to people

and if you legalize it but ban direct monetization, I think it also satisfies 99% of people
