No, it is just straight up legal
you can make an emulator illegally (hacking to get sourcecode, etc), but an emulator cannot be illegal
It is also not illegal to sell them for money
it is also not illegal to sell them for money while the thing it is emulating is still on the market
I am pretty sure every single one of those questions has been tested in court

I think what got them was cringe jurors them copying Nintendo's source code to get games running
