As far as I know, the rights holder has to have reasonable awareness of the IP infringement and refuse to act to lose rights. I highly doubt the management of The Escapist gives anywhere near enough of a shit to look into it without being prompted, and I wouldn't be surprised if they actually just let the rights lapse at that point.
